Gen Christian Tshiwewe Hints at Holding Sensitive State Secrets, Requests Provisional Release from Military Court

The trial involving General Christian Tshiwewe Songesha, the former Chief of Staff of the Armed Forces of the Democratic Republic of Congo (FARDC), continues to attract significant attention due to the seriousness of the charges against him and the high-ranking position he previously held within the Congolese military leadership.

During a hearing held on Tuesday, July 21, 2026, Gen. Tshiwewe’s defense team requested that the Military High Court grant him provisional release, arguing that there are no substantial reasons to justify his continued detention. The defense further emphasized that the former army chief possesses highly sensitive national security information and state secrets, arguing that he should not remain detained at Ndolo Military Prison.

Gen. Christian Tshiwewe is one of the senior military officers who played a major role in the leadership of the Congolese armed forces in recent years. He previously served as Chief of Staff of FARDC, commanded the unit responsible for protecting senior state officials, and later became a military and security adviser to President Félix Tshisekedi.

He was arrested on August 9, 2025, following allegations of involvement in an alleged plot aimed at overthrowing the government of President Félix Tshisekedi.

The prosecution has charged him with serious offenses, including treason, inciting soldiers to commit acts contrary to the law, and illegal possession of firearms. According to the prosecution, these charges are linked to an alleged attempt to destabilize and overthrow the current government.

Gen. Tshiwewe is standing trial alongside several other senior military officers, including Major General Maurice Nyembo, Brigadier General John Ngoy Kabila, Brigadier General John Sangwa Muhemedi, Colonel Guy Mukombozi Zahinda, Colonel Pathy Sangwa Lumbu, and Colonel Christophe Tshibangu Kenge.

Other individuals implicated in the same case have not appeared before the court, including General John Numbi, former Inspector General of the Congolese Armed Forces and former head of the national police, Brigadier General Chinyabuuma Pascal Kamukinde, and civilian Pascal Nyembo. Authorities say these individuals are considered to have fled from justice.

The trial officially began on June 4, 2026, with the court initially verifying the identities of the defendants before proceeding to examine the substance of the charges.

During Tuesday’s hearing, July 21, 2026, Gen. Tshiwewe’s lawyer, Me Parfait Kanyanga, formally requested that his client be released on a provisional basis and allowed to continue defending himself while outside detention.

He argued that Gen. Tshiwewe has no intention of fleeing justice and that there are therefore no grounds for the court to maintain his detention.

The lawyer also stressed that his client served in key positions within the national security structures of the Democratic Republic of Congo and therefore possesses highly classified information related to the country’s security. According to Me Kanyanga, keeping Gen. Tshiwewe detained at Ndolo Military Prison does not reflect the responsibilities he previously held within the security sector or the importance of the state information in his possession.

Me Kanyanga further argued that the circumstances surrounding Gen. Tshiwewe’s arrest and prosecution were allegedly carried out in violation of legal procedures, claiming that no preliminary investigation had been conducted before his detention.

He told the court that the prosecution had not presented concrete evidence demonstrating that his client committed the alleged offenses in a manner that would justify continued pre-trial detention.

Other defendants in the case, who are also detained at Ndolo Military Prison, raised similar concerns and requested permission to stand trial while free as judicial proceedings and investigations continue.

So far, the Military High Court has not yet ruled on the request for provisional release. The court is expected to examine the arguments presented before issuing its decision in the coming days.

The case continues to be closely followed by political and security analysts, as it involves several senior military figures who played influential roles in the leadership of the Congolese armed forces in recent years. The court’s decision could have significant implications for the continuation of the trial and the broader image of military justice in the Democratic Republic of Congo.
